Internet Needs an Uncompromising "Marco Civil" in Brazil!

Together with 27 other european civil rights groups  Aktion Freiheit statt Angst has signed an appeal to the Brasilian parliament and the Government to approve the Marco Civil Act in its original and unique shape.
 
With this step we support the President of Brazil, Dilma Rousseff, who wants the consent to this law as quickly as possible by the Parliament. After the revelations about massive illegal spying on the people around the world and in Brazil, too, this law could provide freedom on the Internet in different directions.

Internet Needs an Uncompromising "Marco Civil" in Brazil!

The "Marco Civil da Internet" is a remarkably progressive legislative text to protect Internet and fundamental rights online in Brazil. It has been drafted through an unprecedented collaborative effort involving citizens. But for the past 3 years, it has remained stuck in Parliament, under heavy pressure by industry – mostly telecom – lobbies. 
 
Recent revelations of massive illegal spying by the US on citizens worldwide, as well as on companies such as Petrobras, urged the president of Brazil Dilma Roussef to put "Marco Civil" back on track in Parliament, in an emergency procedure.
 
The "Marco Civil", guaranteeing Net Neutrality, protecting privacy and freedom of publication online, is more necessary than ever. If adopted, this law will be a model of what citizens and their representatives in all countries can do together to enable the development of a free and open Internet and protect freedoms online.
 
A corporate takeover of the text such as on the questions of copyright (paragraph 2 of art.15) would amount to empty the text of its meaning. 
 
Provisions aiming at protecting privacy and preventing surveillance should be added and all measures which risk harming the possibility for citizens to collaborate on an international scale should be removed.
 
We encourage Brazilian citizens and Members of the Parliament to work towards adopting swiftly an uncompromising "Marco Civil", consistent with its initial spirit, free from corporate influence, and that would truly guarantee freedoms online. 
 
You can count on our support as such a law would be of global importance for the Internet!

O  "Marco Civil da Internet" é um texto legislativo marcadamente progressita para proteger a internet e os direitos fundamentais em território digital no Brasil. Foi redigido num processo colaborativo de cidadãos sem precedentes. Mas nos últimos 3 anos permaneceu suspenso no Parlamento, sob intensa pressão do lobby da indústria – sobretudo empresas de telecomunicações.
 
As recentes revelações de espionagem em massa levada a cabo pelos EUA sobre cidadãos do mundo inteiro, bem como companhias como a Petrobrás, urgiram Dilma Roussef, a presidente do Brasil, a trazer o "Marco Civil" de volta à agenda do Parlamento, num procedimento de urgência.
 
O "Marco Civil", garantindo a Neutralidade na Rede, protegendo a privacidade e a liberdade de publicação online, é mais necessário que nunca antes. Se adotado, esta lei será um modelo do que os cidadãos e os seus representantes em todos os países podem conseguir juntos para permitir o desenvolvimento de uma Internet livre e aberta e para proteger as liberdades online.
 
Uma apropriação corporativista do texto como nas questões de direitos autorais (2º parágrafo do 15º artigo) esvaziaria na prática o significado do texto.
 
Deveriam ser adicionados provisionamentos direcionados à proteção da privacidade e à prevenção da vigilância e todas as medidas que colocam em risco a possibilidade dos cidadãos colaborarem à escala internacional deveriam ser removidas
 
Encorajamos os cidadãos Brasileiros e os seus Parlamentares a que trabalhem juntos na adoção célere de um "Marco Civil" irredutível, consistente com o seu espírito inicial, livre de influências corporativas, e que assegure verdadeiramente as liberdades online.
 
Podem contar com o nosso apoio pois tal lei seria de importância global para a Internet!
